THIS JUST IN – EEOC Issues Updated Guidance on COVID-19 Vaccinations |

Earlier this week, we released an e-alert addressing the availability of a COVID-19 vaccine in West Virginia and steps that employers can or cannot take when it comes to requiring their employees to receive the vaccine. The alert specifically referenced guidance from the U.S. Equal Employment Opportunity Commission (EEOC) dated March 21, 2020.
Today, the EEOC posted an updated and expanded technical assistance publication addressing nine questions arising under the Federal Equal Employment Opportunity Laws related to the COVID-19 pandemic, including an updated Q&A section on vaccinations and detailed information on how and/or when employers can require employee vaccinations without violating the EEO laws.
Our team is currently reviewing the updated guidance from the EEOC, and additional e-alerts about the national vaccine rollout and/or EEOC's guidance may be forthcoming.
