Unaiza Tyree

Unaiza Tyree is a litigator in the Charleston, West Virginia office of regional law firm Bowles Rice. She handles a variety of different litigation matters but primarily focuses her practice on medical malpractice, wrongful death, and commercial litigation.

Over the course of her career, Unaiza has gained extensive courtroom experience representing a wide variety of clients in both state and federal courts throughout the region. She is also adept at pretrial litigation, motions practice, and has successfully represented clients in alternative dispute resolution, including mediation and arbitration. Unaiza’s practice also includes representation before the professional licensing boards in the State of West Virginia, particularly when a licensing dispute arises or disciplinary actions could affect a professional’s ability to continue working in his or her field.  

A substantial part of Unaiza’s practice is also focused on preventing litigation for professional clients. Understanding the effect litigation can have on a business, Unaiza advises clients on strategies to minimize exposure, attain favorable outcomes, and achieve other alternative dispute resolutions to avoid unnecessary litigation. However, when litigation is necessary, Unaiza has the valuable experienced needed to attain favorable outcomes with the client’s best interests always in mind.

An active member of the State’s abuse and neglect docket, Unaiza also spends time on various pro bono matters throughout the year. 

Representative Experience includes:

  • Dana Martin v. Rising Stars Childcare, et. al.,  Civil Action No. CC-41-2023-C-19, in the Circuit Court of Raleigh County, West Virginia (motion to dismiss granted after oral argument on behalf of all defendants on September 28, 2023);
  • Estate of Timothy Rush v. Danasdome, LLC d/b/a The Dome Bar & Grill, Circuit Court of Kanawha County, West Virginia, Civil Action No. 20-C-832, August 24, 2022 (granted complete dismissal of all claims on Motion for Summary Judgment after oral argument for Kuppel, LLC) (affirmed by the West Virginia Intermediate Court of Appeals on June 15, 2023); 
  • Lisa Fields v. City Insurance Agency, Inc., Circuit Court of Mingo County, West Virginia, Civil Action No. 21-C-27, June 1, 2021 (granted dismissal on Motion to Dismiss after oral argument for City Insurance Agency, Inc.);
  • Wilcox v. Williams, Circuit Court of Lewis County, West Virginia, Civil Action No. 17-C-53, January 17, 2019 (granted dismissal on Motion to Dismiss after oral argument for AFP Logs and Lumber, LLC with prejudice).
  • Grant of summary judgment for plaintiff in the Circuit Court of Pendleton County, West Virginia on unlawful conversion claims.
  • Grant of motion to dismiss for correctional officer in the Circuit Court of Kanawha County, West Virginia based upon statute of limitations arguments.
  • Successful representation of various medical doctors before the Complaint Committee of the West Virginia Board of Medicine with favorable resolutions.
  • Complete dismissal of ethical Complaint pending before the West Virginia Board of Respiratory Care by unanimous decision.
  • Complete dismissal of ethical Complaint pending before the West Virginia Board of Examiners of Psychologists by unanimous decision.
  • Successfully handled various jury trials in magistrate court with judgment rendered in favor of her clients
  • Multiple dismissals of West Virginia Board of Medicine complaints prior to her clients undergoing a formal investigation.
  • Manages and handles electronic discovery for the firm’s litigation department.
